how to use the spillover is purely an USCIS decision. Only to use the spillover to avoid wastage is a law, which is already in place. Infact USCIS was not doing this top down approach on spill over few years ago, this is a new practice they are following since last Fiscal Year, so I strongly believe if Congressmen/women puts pressure/more request it can be changed to a fair application of visa spillover to benefit all that are in the queue for a long wait.

I am not sure if I am correct,
Although no. of visas are awarded "EB category + country" wise, but spillover is not awarded in same fashion.
.e.g. 3000 visa comes to EB2 I & 3000 visa comes to EB3 I.
But spillover comes from EB1 to EB2 irrespective of country. And reason why EB2 I is far ahead is because of spillover gain before it reaches to EB3.
Even if some EB2 I guys are not happy with EB3 person porting to EB2, shouldn't they calm down as whoever is porting taking benefit from spillover for EB2 world and not from spillover EB2 I.
My assumption is spillover comes to "EB2" and not "EB2 + country" wise, if that is not correct then my point is nullified.
The number of visas are awared "(EB + FB) Country" wise. The 7% limit is on the total green cards issued to a country regardless of category. There are two types of spillovers
1) The spillover from EB1 -> EB2
2) The spillover from FB -> EB
In the first scenario the spill over happens from EB1 to EB2 regardless of category, the spillover visas do not have any country cap or other limitations and hence are awarded to the oldest priority date applicants in the EB2 category. (This is why China doesnt support country cap removal as USCIS gives the oldest application the highest priority and most of the older applications are from India). IFF all the EB2 categories are current and there are no more pending EB2 applications the visa numbers spill over to the next category i.e. EB3. Therefore until all of EB2 is current EB3 will not receive any spillover visas.
In the second scenario the spill over happens between the FB and EB categories. If a certain country has not used up its entire FB quota additional number of EB visa's will be made available to the applicants of that country. e.g. If Korea has a total limit of 100 visas, which are evenly split between the EB and FB categories so they each have a limit of 50 visas. Only 20 people applied in the FB categories but 80 people applied in the EB categories. USCIS will approve all those applications even though the EB applicants far exceeded the EB limit.
India doesnt benefit from the FB<=>EB spillover as there are sufficient number of FB applicants as well.
And this is how the cookie crumbles.

Law clearly states employer cannot discriminate based on immigration status.
Walking dude has a point. I think we should take this up. We shouldn't be calling the employer and notifying them. We should notify the ad to appropriate authorities.

How can contributing $1000.00 to immigration voice solves this problem? You are telling like a swami's in India, give me money I will do some pooja on your behalf and all your problems will be solved.
The money is not for me or for the Immigration Voice but for the lobbying to make the uscis or the government understand how the employment based GC system is outdated, and how the people who came to usa with an American Dream are being played by the rules not for days or weeks or months but for years and years. And procrastinating their American Dream because of the limitations they have during the GC process.
Active participation or contribution of 10 or 20 or 100 people wont be any effective unless and untill we all do it collectively.

I feel sorry for EB3 folks even though I'm under EB2. But I get upset when some of the EB2 folks don't even know the reason why they started getting green cards recently all of a sudden ( b'coz of roll over). They don't educate themselves and talk as if they deserve the green cards. If was a collective effort from IV and fellow immigrants that pressurised USCIS to follow the rules and reduce the backlogs.
Are you implying every person born in India in the EB2 owes a debt of gratitude to IV?
Why do people not deserve their greencards? If they followed the law, stood in line, and the government of the USA deemed them fit for a GC what else do you need for them to be deserving? Touch your feet and get your blessings?

I had an RFE from NSC that they wanted to see experience letter from employer from specific format. They specifically said in RFE that they didnt want to see affidavits or paystubs or offer letter or any other document. Remember EB2 category criterion is "5 years of progressive work experience" word progressive is important and offer letter doesnt prove it.
If you havent been in this situation, do not offer unnecessary advise based on your gut feeling.

Has anyone recently done Canadian Landing with pending 485 and any issues re-entering US with AVR/H1B/Advance Parole?
Any problem with H1-B stamping the same visit as you do Canadian Landing?
Can one apply for a 'Canadian Visitor Visa', while there is a valid (not used) Canadian PR Immigration Visa stamp in your passport?
I would appreciate your replies/experiences.

Hey, Anyone whose checks cashed but still didnt get their receipts? My checks were cashed 5 days ago. So far no receipt notices.. I got the receipt no's from back of the checks and the lud on 765 is 9/7 but it still says we mailed out a notice on how we process this case.....

Brother your assumption is flawed if someone come under reservation category they get their guaranteed reservation seat (on their merit basis in that class) if reservation % is fulfilled as per rule then their application goes to open category. That means 50% resources is for everyone in India.
This was happened few years back to get admission in one of top Medical school after scoring more than 92% was not able to get to desired top medical school but one of his friend who had just scored 58% was able to get in top notch medical school. Now this remind me similar situation what was happened 50 years before. Now making matter worst student who had got 92% was belonging to very middle class or you can say poor family but his friend was belonging to class one gazetted officer�s family (I would classify them upper middle class).
I think reservation was required in past to up-lift backward class and give them justice in system but now situation is change drastically we see people from all class is on same page .if someone wants to argue on this that is fine. In real sense if we need reservation then it should be on economics basis everyone should file taxes and they should get reservation accordingly with merits .In this way government will get more revenue and on the whole we will have fair justice to everyone (all cast )and this will provide better visibility what is happening to normal families. Now some will debate how we can avoid fraud for reporting low income then hey that is what government should be doing, proving infrastructure and enforcing rule of law other than that government has no business in dictating which cast is upper cast or lower cast.
Now real question pose by the other users here are we better-off here or back home? I think we always indulge in material benefits but there are other aspect of life you cannot put face value on it .What matter is the most are you Happy? What is your ultimate goal of life? What is the most important thing you want to have in your life? What is the most irritating thing you cannot overlook or make you uncomfortable? On top of all these key questions what are tools /resources available to you to address all these likes dislikes. So let us say if you are shooting for quality life then define what must have for that life and to get those you may have to bite bullet and compromise on some of those. If you can find middle ground some where there then we call those people happy people or successful people. So life is about making right choice all the time as per your own situations. When we are in this fine-tuning process we can always use help from our resources, friends, relative, culture, God, Money and our own intellectual.

My best friend (brightest among all of my school friends) in India belonging to Backward class could not study medicine or engineering because he had (no money) to support his family..... so he finished his shortest teaching course and became public school teacher.... He was capable of getting into any medical school without reservation help... and because he belonged to lower cast he was assured in any medical college with the help of reservation.... this reservation system does not work for real lower cast or for people who really need uplifting..... between I could not get into medicine because I was 1 mark short...... Just 1 mark..... :) ..... I am really happy were I am but reservation is a plague that is corrupting our nation.......
