I did not call them to get the RNs but I got the I-485 checks cashed for my wife and me.
The checks for I-485 for my daughter and the checks for AP and EAD were not cashed though.
But again, looks like, July 3rd 9:03 received by R. Williams, is no more a MIA case.
By the way the receipt date is marked as Oct 10th. Service center is NSC.
I am july 3rd filer and Just got the receipt numbers..Looks like our box is not lost and interestingly my numbers start with LIN even though my 140 processed from SRC.

Wanted to know what the members here think of the probability of receiving RFE from USCIS to find out whether the applicant is still in a "same or similar" job when the time comes to adjudicate cases for for EB3 India.
I ask this because in a poll conducted in a separate thread, it seems the number of people waiting for their GCs are more with PDs before Dec 2004 than after that date.
When the dates become current again for these people, do you think USCIS will be sending RFEs to get the employment information for every single of them ? Is there is a percentage from the pending applications that they pick for RFE, assuming all applicants who changed employers DID NOT notify USCIS when they changed jobs OR is it completely up to the whims of the adjudicating officer to send an RFE ?

My employer filed my wife's and my EAD paper based application on Jul 25, 2008 (TSC Received Date). But I still haven't received the Receipt notices for the same.
Generally how long does take to get the receipt notices?
Please let me know if any has filed around same date and received the receipts?

Well, it goes beyond that. This is a "complicated story with no sub titles".
IV website is a board where people of all kinds visit and there is no control over stuff. Just go to any blog site - we see 100 rants and crazy comments as against a few wise talk.
I guess we have to live with it and keep pushing people. Sometimes loud and sometimes gently.
My friend, it is to "push the people" that I am saying all this. How best can we push? Through word of mouth, or thru full campaign?
Another idea: How about restructuring the forums?
In the home page, we promote only those discussions that are important to all, like advocacy.
In next tab, we take on the discussions that are based on individual problems
And all else, can go to the third tab
Also on home page, the following items (just some examples of general interest matter):
- Advocacy day. Donations received vs required.
- Big red button: Donate
- Some links to recent news items on immigration

I have a question about Landing with Own car? Is there a way to get around importing it? I want to use my own car but don't want to pay import fee etc. Did they charge you anything? How much was it? What else to expect, do you think you will have to take it to Canada Tire etc. for Federal appointment etc?

All mine and my spouse's applications were transfered to Vermont. my I-140 was approved from TSC. My checks were cashed on July17th and that is how I know that it is pending at VSC.
Yesterday I got an email that Card production ordered for EAD. All applications applied on July 6th. I am not sure on what basis they transfered. But it looks like Vermont has started approving the EAD cards. Hopefully, I will get it soon too in the mail.

In Fox News this afternoon, the senator has explicitly said that the Chicago lady does not have any "constituional rights" since she is not American citizen. Go figure what they think about us.
she can say whatever. the courts have to agree.
if she says that constitutional protections don't apply to non-citizens, they are essentially reinstating slavery.
not that the constitution was against slavery.

I called there office but no clue what SKIL bill is about (Washington DC).
Can any one explain the source of this bill.
First and foremost, DO NOT CONTACT Sen. Cornyn's office.
We are privy to some information and we were told that Sen. Cornyn might introduce this to the senate today. When we say might, it means that there is a good chance he may not do so too!
And introducing just means that he will get a number assigned to it. It will NOT be debated today. The debate timeframe is decided by the majority and minority leaders Frist and Reid respectively.
We just wanted to share with you what we learned. When we learn more, we will let you guys know. For right now, all we know is in the first post.
And FYI, there are some decent provisions in this bill especially related to STEM. Also presents a solution to retrogression wherein Adjustment of Status would be possible in spite of no visa being available.

I don't know how you have calclated that. As far as I remember seeing various threads on this forum, there are atleast 5-6K EB3 in 2002 and similar number in 2003 for India. Considering 2.5 number used per family I an guessing we need atleast 20-25K Green card numbers for EB3 to move beyond 2003. With just 3300 EB3 available per year, my guess is it'll take 4-5 years for cuttoff dates to go past 2003. I may be pesimistic, but this country's immigration system has taking all optimism out of our American dream...
Are we sure that there are around 5-6k EB3 pending in the years 2002 and 2003. If thats true then it will take atleast 6 more years to process all the EB3's for 2002 and 2003 :(

People, the bill is called "Comprehensive Immigration Reform". It can only be comprehensive if it takes into account the legal population and the illegal population. This bill could not come at a better time for us with the mid-term elections coming up. The Executive Branch of Government is pressuring for passage of this legislation. It will be a huge issue for the mid-term elections. The Republican House is in a no win situation, passage means amnesty (their words, not mine) and non-passage makes them look ineffective. For now all we can do is sit back and wait and watch. It will take the majority of the house spin doctors a while to figure out how to proceed with maximum benefit for the Republican Party. This is the nature of politics.
For a little entertainment, we can always predict next months visa bulletin! (Sorry, I couldn't resist).

You are in the EB3 category, do you ever wonder why somebody who is more educated than you or me, makes more money? Can we say, hey you I was born in 1890 I should make more money, it does not fly, EB3 is not a reflection on your skills but more the job you hold.
The question you should ask is why have EB1, 2, 3, etc?
Why do you not include the family based categories, isn't family first, why not the EB spill over to to FB first then whatever trickles down comes to EB, is not this fair? I am sure there are a lot in the FB queue who have waited for longer than you. Now dont tell you you are better than FB because you are highly skilled, pay taxes, etc.

What happens when 485 is pending for more than 180 days and a person already used EAD for his current JOB(because of the policy of the Employer saying that: Once they apply for EAD employee needs to use EAD and company will not extend H1B anymore). Eventually employee will use EAD.
The he loses his JOB(with Current Emlpoyer who is the sponsorer of 140 & 485)? And say he remains without similar JOB for example 2-4 weeks and then finds a JOB with similar JOB description? Does he still remain on Adjustment of Status? Does he needs to be continuously employed till his 485 is adjudicated?
Please provide some input. All your opinions would help many folks!

For those who doubt that a definitive initiative is needed for the Legal immigrant community, may I humbly remind them of the most basic and the most important phrase of the US Constitution..."Every human being has the right to Life, Liberty and the Pursuit of Happiness". What has been happening with all this memos and counter-memos and visa bulletins from the USCIS and the DOS is a denial of our basic human rights...first as Human beings and then as Legal Immigrants. Friends we can possibly build a strong case based on the informed readings of the US Constitution and Law. We have done nothing wrong to get such treatment buy these departments. We have followed every law and requirement that the US Immigration Law has prescribed but because of the sheer number of immigrants from India and China we are being disadvantaged and discriminated by the US Congress, certain laws and by these departments. It is not a legal immigrants fault that the US Law does not limit the F1 visas issued in a year by country and the number of jobs applied under H1b program by country. The endless delays in the GC process clearly disadvantages the legal immigrant community from large countries like India and China compared with legal immigrants from other countries and even US citizens. They clearly cannot pursue their dreams of prosperity, career advancement, security (for himself and family via education, jobs and homes) and overall happiness. Justice delayed is nearly always denied.
