    DOS and USCIS are slow. But it would be really helpful if the IV code team can provide some update on our site. I believe over 2.5 hours have passed since the last update regarding some update in 1 hour. I guess we can't do anything if it takes more time but an update always helps! Thank you.

    Please have some patience. IV core are working professionals like you and me. This is not their full time job and they are doing this in their spare time. They will update us as soon as the news is out.

    A divorce will not benefit anyone. Think about all the time you spent with each other as an investment. A job, and a little independence should not change your attitude. Think of the kids futures what they have to go thru. Its a total loose loose.

    If you absolutely have to go thru with the divorce. Find a US citizen or maybe a GC holder who will be ready to marry you right after the divorce. Then you don't have to go out of the country. Or else reason with your husband to hold off on the divorce till GC.

    Anybody thinking of trying a lawsuit in US should better think again. It's of NO USE. It will only aggravate the average Americans and you will lose whatever little support we have from moderates. Lawsuit will yeild nothing.

    We must try Gandhian approach of appealing to their innate sense of justice.

    Only President bush can do something if somehow he can be convinced.
    People already sued USCIS couple of years back and lost the battle.Sad to hear about 15,000 people with their futures undecided.I also heard that many doctors are leaving US as they are unable to find a residency program.

    Democrats seem to be loosing senate seat in MA. Message is clear - in this great recession, people don't want more taxes especially when they are happy with their current healthcare policies and their healthcare coverage don't change a dime for those extra taxes. Especially, when MA people are already paying for state universal healthcare. Why should WE pay for THEM?

    Probably, this means healthcare reform is dead or congress embraces more conservative bill passed by senate. End of road for more tax burdensome things like cap-n-trade, climate change bill or controversial bills like immigration reform unless some less-conservative republicans are on board. If it is ever considered, be ready for more durbin-grassley measures in the final bill. Fate of the bill depends on what matters for elections in 2010, probably more populist measures like tax cuts, another stimulus, job growth measures will be focussed for rest of the year..

    Next project, get a new h1, so, if you add that up, they can collect 600 Mil
    and the client will most likely go belly up :D

    As per the law, your H1B will still be valid even in if I-140 is revoked. However, the only flip side is one will lose the old priority date.
    For sure, this is exactly outlined in the law. I have known some cases who are working successfully and legally on H1Bs even after their I-140s revoked (by the way one of them is in 8th year of H1B)

    I work for a good consulting company, completed 3 years in that company.
    Since it is a consulting company my pay is less unless i go full-time.
    I started thinking about going full-time with other companies and got offers from two companies.
    My suggestion would be to contact Murthy.com or Rajiv.s.Khanna to double check what i said



    Now my dilemma is that if i switch companies, my current employer(consulting) might revoke my I140 and use it for labor substitution. I talked to different lawyers about validity of the H1B extension based on I140 approval. All of them say ask your old employer not revoke I140. If I140 is revoked, H1B extension could be invalid. Currently DOL/USCIS does not have a process/bandwidth to handle revoking H1Bs pro-actively.

    I decided to take my chances and take one of the new offers. Worse case, i will go back to india. Wait may be that be the BEST case, i could work for a startup:)

    Since H4 is a derivative visa depending upon an H1, as long as the H1 is valid you can be in that status also whether you use EAD or not. However you can not be in H1 and using EAD. You have to get a new H1 to be again in H1 after using EAD. Anyway how does it matter whether it is valid or not? It becomes a problem even for H1 visa holders, only when I-485 is rejected.

    The health benefit is actually indicated in my employment contract as part of my employment package. However, they later informed me that the health benefit is already part of my salary.

    I actually signed a non-compete contract with my current employer(which means I cannot work for my current client if I switch employer). Now, I'm planning to move to a different employer, but I would be assigned to the same client. Can I argue that since they did not give me the health benefit that they promised me, then it should be okay if I violate the non-compete contract? Do you guys think I have a point of defense?

    Just got back from UK on Friday after a month of family time, medicals and our embassy interview! Wanted to let you all know that we were approved and happily back in the US!!

    Congrats on the latest admin wins and movements in campaigns/projects. I wanted to say a huge thank you but not farewell to the many kind folks who kept my spirits high in the short time I have been with IV:

    Isn't it amazing, thousands of people are waiting with bated breath for the USCIS update news and some idiot opens a new threads to start a baseless rumor. And claims that news comes from Greg. This so called news as it turns out is a comment by some troll "south" on Greg's website.

    Our friend here who opened this thread fails to even see the connection between the id handle "south" and his post" going south." Honestly, things like this make you wonder, how can such people call themselves highly skilled.


    You will be proved biggest idiot when what you believe today is turned out to be wrong tomorrow. Who are you , a thread czar ?

    If you don't like it, just move on.

    <>Labor filed in Nov 2005 under EB2 and approved
    <>-I-140 Approved somewhere Aug 06
    <> I then left Company 1 and joined a multi national IT Giant in India - Infosy. Joined Info - Jan 07 in India . BUT I was in good terms with Company 1
    <>Came back to USA , as Infosys Employee around Sep 07 on B1 visa from India for 3 months . Went back to India.
    <>Rejoined Company 1 ( my Original Company ) in Jan 08 ( Petition approved) . Got visa stamp around June 08 and entered US. Got Project Aug 08 and since then on project till date.
    <> While on project Aug 08 I apply for I485 as my category EB2 became current. Got my FP done.
    Then Around Nov 08 I got EAD and AP papers. So I have an EAD and AP

    My Q's are
    <> I heard that EB2 is retrogressing to 2000 for India . Now does not apply to folks whose LC and I140 Is approved or only for those who are stuck up at I140 Stage.
    Please clarify on this. If I am in a stage where I am expecting my GC and already for EAD does it apply to me
    <> What is a VISA Number. There is an A# Number on MY EAD and that same number shows up on AP Document ( I512-L Authorization for parole ) . Is this the same as an Immigrant Visa # or that is something that issues when I am granted my GC.
    <> 6 months have passed since I got my EAD. If I join a new Employer and start using this EAD , can I renew it infinitely, till I get GC . What if My Visa is Not valid and I travel out of US to India solely on EAD? What happens then ? is there a chance that at port of entry my entry is denied based on my immigrant future intentions?     Are amnesty and open borders in our future?

    Before election night was even over, White House spokesman Tony Snow said the Democratic takeover of the House presented “interesting opportunities,” including a chance to pass “comprehensive immigration reform” — i.e., the president’s plan for an illegal-alien amnesty and enormous increases in legal immigration, which failed only because of House Republican opposition..

    At his press conference Wednesday, the president repeated this sentiment, citing immigration as “vital issue … where I believe we can find some common ground with the Democrats.”

    Will the president and the Democrats get their way with the new lineup next year?

    Nope.

    That’s not to say the amnesty crowd isn’t hoping for it. Tamar Jacoby, the tireless amnesty supporter at the otherwise conservative Manhattan Institute, in a recent piece in Foreign Affairs eagerly anticipated a Republican defeat, “The political stars will realign, perhaps sooner than anyone expects, and when they do, Congress will return to the task it has been wrestling with: how to translate the emerging consensus into legislation to repair the nation's broken immigration system.”

    In Newsweek, Fareed Zakaria shares Jacoby’s cluelessness about Flyover Land: “The great obstacle to immigration reform has been a noisy minority. … Come Tuesday, the party will be over. CNN’s Lou Dobbs and his angry band of xenophobes will continue to rail, but a new Congress, with fewer Republicans and no impending primary elections, would make the climate much less vulnerable to the tyranny of the minority.”

    And fellow immigration enthusiast Fred Barnes earlier this week blamed the coming Republican defeat in part on the failure to pass an amnesty and increase legal immigration: “But imagine if Republicans had agreed on a compromise and enacted a ‘comprehensive’ — Mr. Bush’s word — immigration bill, dealing with both legal and illegal immigrants. They’d be justifiably basking in their accomplishment. The American public, except for nativist diehards, would be thrilled.”

    “Emerging consensus”? “Nativist diehards”? Jacoby and her fellow-travelers seem to actually believe the results from her hilariously skewed polling questions, and those of the mainstream media, all larded with pro-amnesty codewords like “comprehensive reform” and “earned legalization,” and offering respondents the false choice of mass deportations or amnesty.

    More responsible polling employing neutral language (avoiding accurate but potentially provocative terminology like “amnesty” and “illegal alien”) finds something very different. In a recent national survey by Kellyanne Conway, when told the level of immigration, 68 percent of likely voters said it was too high and only 2 percent said it was too low. Also, when offered the full range of choices of what to do about the existing illegal population, voters rejected both the extremes of legalization (“amnesty” to you and me) and mass deportations; instead, they preferred the approach of this year’s House bill, which sought attrition of the illegal population through consistent immigration law enforcement. Finally, three fourths of likely voters agreed that we have an illegal immigration problem because past enforcement efforts have been “grossly inadequate,” as opposed to the open-borders crowd’s contention that illegal immigration is caused by overly restrictive immigration rules.

    Nor do the results of Tuesday’s balloting bear out the enthusiasts’ claims of a mandate for amnesty. “The test,” Fred Barnes writes, “was in Arizona, where two of the noisiest border hawks, Representatives J.D. Hayworth and Randy Graf, lost House seats.” But while these two somewhat strident voices were defeated (Hayworth voted against the House immigration-enforcement bill because it wasn’t tough enough), the very same voters approved four immigration-related ballot measures by huge margins, to deny bail to illegal aliens, bar illegals from winning punitive damages, bar illegals from receiving state subsidies for education and child care, and declare English the state’s official language.

    More broadly, this was obviously a very bad year for Republicans, leading to the defeat of both enforcement supporters — like John Hostettler (career grade of A- from the pro-control lobbying group Americans for Better Immigration) and Charles Taylor (A) — as well as amnesty promoters, like Mike DeWine (D) and Lincoln Chafee (F). Likewise, the winners included both prominent hawks — Tancredo (A) and Bilbray (A+) — and doves — Lugar (D-), for instance, and probably Heather Wilson (D).

    What’s more, if legalizing illegals is so widely supported by the electorate, how come no Democrats campaigned on it? Not all were as tough as Brad Ellsworth, the Indiana sheriff who defeated House Immigration Subcommittee Chairman Hostettler, or John Spratt of South Carolina, whose immigration web pages might as well have been written by Tom Tancredo. But even those nominally committed to “comprehensive” reform stressed enforcement as job one. And the national party’s “Six for 06” rip-off of the Contract with America said not a word about immigration reform, “comprehensive” or otherwise.

    The only exception to this “Whatever you do, don’t mention the amnesty” approach appears to have been Jim Pederson, the Democrat who challenged Sen. Jon Kyl (a grade of B) by touting a Bush-McCain-Kennedy-style amnesty and foreign-worker program and even praised the 1986 amnesty, which pretty much everyone now agrees was a catastrophe.

    Pederson lost.

    Speaker Pelosi has a single mission for the next two years — to get her majority reelected in 2008. She may be a loony leftist (F- on immigration), but she and Rahm Emanuel (F) seem to be serious about trying to create a bigger tent in order to keep power, and adopting the Bush-McCain-Kennedy amnesty would torpedo those efforts. Sure, it’s likely that they’ll try to move piecemeal amnesties like the DREAM Act (HR 5131 in the current Congress), or increase H-1B visas (the indentured-servitude program for low-wage Indian computer programmers). They might also push the AgJobs bill, which is a sizable amnesty limited to illegal-alien farmworkers. None of these measures is a good idea, and Republicans might still be able to delay or kill them, but they aren’t the “comprehensive” disaster the president and the Democrats really want.

    Any mass-amnesty and worker-importation scheme would take a while to get started, and its effects would begin showing up in the newspapers and in people’s workplaces right about the time the next election season gets under way. And despite the sophistries of open-borders lobbyists, Nancy Pelosi knows perfectly well that this would be bad news for those who supported it.

    All the posts that I have seen on the forum are related to what we should ask for regarding ammendments and changes to the proposed bills.

    Why don't we also offer our services in return for quick approval????

    This is part of the idea that I had a while back after listening to Prez. Bush's address to the nation. He said that the fed will increase funding to increase the number of Science and Maths teachers. Well, why don't we offer our services. Anyone working in the STEM fields shall have to work for say 4 hours a week at local schools teaching Science/ Maths, etc. We know all desis can do that. Most have an engineering background or are good at math anyways.
    This way the government can
    1. solve the teacher shortage problem
    2. provide more students (future generations) with the education
    3. can actually show that legal immigrants add value to society at the grass root level

    I am sure that we can and do much more, but most is not directly visible to the population. This has the potential to provide a big impact.

    Here in Europe the biggest problem is ATMs that has been modified. The most simple modification is a simple loop inserted into the slot that tries to fool its victims into believing the machine ate their card. In addition a helpful person will appear and tell the victim that there's a secret code to be keyed in (999 + personal pin code) to make the machine spit out the card again...

    Then they upped the stakes a bit. Today's con-person installs a small card reader at the ATM's slot. In addition there's a small camera (here's the relevant bit) that take pictures as people enter their code. This has been used and such equipment has even been recovered in atleast one case.

    As for someone looking over your shoulder in the store, and perhaps even snapping a picture of it... Well, lets just say you don't want to leave your card out of sight. Don't assume your card is worthless plastic in someone else's hands.

    We card users are basically using yesterday's (actually: last decade's/century's) technology to access our money while the countless villains out there are armed with today's technology. We're sitting ducks.

    The card companies are reluctant to tell us this, but eventually as they roll out new technology (smart cards with bio-signatures) it will become blatantly apparent to everyone. Here in Norway they're scheduled to do this over the next year I think.

    Today the Alberta immigration department announced that on April 15, 2009
    the on-demand occupation list of Alberta will be changed. Any applications
    postmarked before April 15, 2009 will be assessed based on the current list.
    All applications postmarked on or after April 15, 2009 will be assessed
    based on the revised list that will be posted on April 15, 2009.

    The possible change

    It is very possible that IT related occupations will be removed from the
    on-demand list on April 15, 2009. The original intent of this Alberta
    program was to recruit H-1B professionals from USA. The economy of Alberta
    was booming in recent 5 years because of the discovery of huge oil reserve
    in the northern part of the province. Alberta needs engineers such as
    Chemical Engineers, Mechanical Engineers, Civil Engineers, etc to work for
    its oil industry and its oil based economy.

    However, it ended up that the overwhelming majority of applicants of this
    Alberta program are IT consultants, programmers and software engineers in
    USA. Alberta does need some IT professionals but it for sure does not need a
    lot of them."

    Is this true? I dont find any info related to this on Maple International website or Alberta Immigration website.

    Its just scary that after all these years they might consider the case abandoned if you don't receive the damn FP letter. Some guys didn't even get the receipts yet. I feel for those...

    P.S.: Anybody got the case closed because they missed the FP appointment ? Is there a way to reopen it ?

    I got denied by discover credit card due to not having a green card.
    They said, it is just their policy that they won't give credit cards to
    people who don't have green cards.
    I could't co-sign my friends student loan application as i did't have a green card. They said, i have to be Permanent legal resident to co-sign.

    Though i have a mortgage now, my first mortagage application got denied on same grounds.

    Apparently fannie mae guildelines stipulates that H1B(foriegn investment) needs to put 60% down to get a mortgage loan.

    But most of the lenders do mortgages anyways even for the people who does't have a ssn:).

    Discover Card is a bit picky...I applied a second time around and they approved it.

    Student loans - federal loans require full citizenship.
